Let’s not judge and be judged. It is just barely four days now since the start of impeachment I believe it is premature to say that the prosecution team is lackluster in the sense that they are unprepared or at a loss when time of litigation. The Administration is not stupid to rely to this team had it been they are not competent to handle such crucial case. There are many more issues in the Articles of Impeachment, there will come a point the defense team could not display their hostile defense. I think the Philippine Constitution provides for two removal tracks of impeachment: "via ordinary criminal conviction & the extra-ordinary-politico-judicial process of impeachment. In fact, scholars agree that by law, ordinary courts could entertain prosecutions brought against judges or jurists, who committed bribery, plunder, and so forth. And a jurist convicted of crimes in a criminal court must immediately forfeit his judgeship. For the sake of evidence & reason, the First Congress of the USA did just that in a 1790 statute.

I'm with CJ Corona if he's owning properties wherever because he's not an ordinary citizen. He can own and buy more condominiums if ever he wishes to have those things. Maybe Corona is a businessman too, worked hard and gained/profit that he's able to acquire all the properties stated. Besides, he's an old man and probably saved much. KOREKTOL: “Senate President Juan Ponce Enrile “assured a fair trial with the decision to be based on the evidence presented and not on public opinion.” LINK Well, the Senate Trial Court set the tone how this case may be decided. Foremost, Counsel Serafin Cuevas contended in his opening statement, which has been admitted in evidence, that CJ Corona has been impeached without notice and hearing which means Corona’s basic Constitutional right that “No person shall be deprived of his life, liberty and property without the process off law” has been violated. I disagree with Dean Rodolfo Palatao of Univ. of Manila when he said that impeachment offenses in the Senate trial are different from criminal offenses in a court of law (see Lynda Jumilla: Justice On Trial.) Dean Palatao should revisit the grounds for judicial impeachment to clarify his argument because "treason" as one of the grounds for impeachment is a serious offense against the Republic of the Philippines. I used to be a regular subscriber of Teddy Locsin's newspaper when I was a student (Undergraduate/Graduate.) at PNC. I disagree with Teditorial argument that the Philippine Supreme Court is 'supreme' & above other branches of the government because it has the power of judicial review---the power to declare congressional acts invalid if they violate the Constitution. But this power simply reflects in the will of the people as opposed to the will of the legislature, expressed in its statutes." Edward: Please revisit US history. Civic textbooks portray US SC as the interpreter of America's supreme law because the Founders hoped that the judiciary would protect the Constitution. What does it mean by a statement on the front of SC building "Equal Justice Under Law?" If you don't know the answer (take note: the answer is 1 word only) read Justice Rehnquist. Could you name a Justice of the US Supreme Court that was convicted & removed from the bench? TONYO queries, "If CJ is removed, there is no JBC that may approve and nominate him for the post of the new CJ. What do you think? From my reading JBC is composed of representative from IBP, professor of law, a retired SC justice, a private sector rep, a rep from Congress, rep from senate, sec of justice. The last 3 serve as ex-officio members. The CJ acting as ex-officio chairman. TONYO, I don't know how they are going to choose the ex-off chairman in lieu of CJ absence. But I'd like to think this - the senate president should act as ex-officio chair to complete the JBC composition. The CJ position should not be left vacant for long time. From 14 justices left the JBC selects the CJ successor, then picks another 1 from outside as the new associate justice.

In defense of Justice Sereno, Justice Carpio & Atty. Vidal: Greek scholars consider justice an essential virtue. It has something to do with fairness & the pursuit of gain, subject to the law. In fact, Aristotle explains the actual origin & necessary condition of justice: Justice in political sense is the way men govern men & living a life toward excellence. Justice in the abstract has to do with balances, or with rules of the mean. In other words, this is a preference of every democratic institution, including the Supreme Court, as a legal institution. Justice Corona must prove to the Senate that his questionable acquisition of wealth, or gain is "subject to the law," not ill-gotten wealth.

These congress people sitting in the prosecutors' panel are no lawyers rich with experience in the courtroom. They are amateurs and acting like lawyers to be (reminds me of the incredible Tony0 in this forum that Deo loves to castigate). ANTONIO CARPIO (senior associate justice) is the only one out of 15 justices who did not vote in the Hacienda Luisita case. Obviously he has the delicadeza to abstain because of his bias towards favoring PNoy's family. Carpio was also the chief legal adviser of TABAKO admin and one can already tell the effect of Cory-Tabako affinity in post-Macoy era to PNoy's regime. Antonio is also the cousin of Conchita Carpio-Morales (Ombudsman), both were appointed to SC by GMA but as it turned out they both look like pro-Wangwang loyalists!

Readers are critical of the actions of the government's panel in the celebrated Corona's impeachment trial.WI don't blame them. These critics have either been exposed to court trials and have seen much court actions as they are portrayed on TV and in the movies. These congress people are like students in high school taking the final exams without studying the night before. RE: Defense Counsel Judge Cuevas: If you listen to his objections all of them involve technicalities to exclude evidence..Is he being looked at as investigating so that the truth will come out..Certainly not..However, Judge Cuevas objects to everything the prosecution puts out the Filipinos are asking themselves? This impeachment comedia is an offshoot of the Hacienda Luisita saga-- which by the way is not yet over --- thus as per Columnist Tiglao of Inquirer suggested , Aquino should declare--- "Whatever the outcome of the impeachment trial against Chief Justice Corona, my Cojuangco clan will not file a case at the Supreme Court asking it to change its Nov. 22 decision on the Hacienda Luisita case. It will immediately withdraw its ‘motion for reconsideration’ filed Dec. 12 on this." For those not in the know-- the Cojuangco filed a motion for reconsideration to change the SC ruling on Hacienda Luisita. Just how providential can this be- that Corona was impeached!!

Yes, the slogan "More fun in the Phil. really fits the description of what's happening in the Impeachment trial. So funny, the Prosecution panel's reaction towards the CJ's SALN. Parang mga "buwayang hayok na hayok" na pinagpiyestahan ang mga docs. Even some Senate judges - kanyang-kanyang reaction sila. Sobrang "LINIS" ng mga taong ito esp. Jinggoy. He's is not in the position to make a comment such as: "something is UNUSUAL in the SALN." Of course, alam niya because he's been there! The mere fact CJ Corona did say that he submits his SALN ever year only proved that he didn't lie. So what if his network went up eversince he moved to SC, dapat lang. Perhaps Mr. & Mrs. Corona filed joint income. (This is the usual practice here in the U.S.)

Sabi ni Justice Corona na mga bigatin daw ang mga lawyers niya na walang bayad at hindi basta-basta (see Punto-Por-Punto interview). In fact, Justice Cuevas was very confused when he stated that Justice Corona's documents that will unmask his ill-gotten wealth or questionable acquisition of properties can't be presented as evidences in the Senate. This will make you puke because Justice Cuevas doesn't know the legitimate end of constitutional democracy or justice itself, which is the protection of the fundamental interests of society, not the mere advantage of particular individuals. Justice Cuevas antiquated judicial reasoning has no place in a modern constitutional system.

Justice Cuevas should ask himself why it is essential for the prosecution to present evidences on Corona's alleged ill-gotten wealth. Corona's lawyers can't simply ignore plain evidence of "violation of public trust" & bribery (bending laws to defraud the BIR & other legitimate government agencies.) You can't ignore plain judicial malignance or corruption. Why? Chief Justice Corona is a symbol of the judicial institution, & President Aquino represent the Filipino people as a whole. Moreover, the Constitution provides a well-structured impeachment process as "a system of accountability." Please support the strong presidency of Nonoy Aquino.

Justice Corona's defence opposes evidence on alleged ill-gotten wealth of Corona because the prosecutors had made the right move that would check mate the impeachment trial. The game of chess is not different from the Senate trial of impeachment. It is a question of evidence or a question of fact or a question of the right move will constitute a good prosecutor, whether he is good in devising the opening & end-game strategies. I think the prosecutors presentations are not that really tupsy-turvy. The best defense of Corona is to create a Homeric or heroic drama: to portay himself as a defender of judicial virtue or excellence. Dramatization is a part of Senate impeachment trial or court-room criminal trial.

In the news: "Corona Richer By P8 Million After Joining SC, SALN Show". From P14.9 Million to P22.9 Million or P8 million difference in Networth. FYI, Assets minus Liabilities (indebtedness or what Corona owed other parties) equals Networth. It's either his properties appreciated well from 2002 to 2010 or he bought properties in cash during that same period. If it is the latter (cash purchases), then "Houston we have a problem". But I am giving Corona the benefit of the doubt because I have not seen the SALN. He may have bought in installment the properties he acquired from 2002 to 2010 yet the appreciation of the property more than offset the remaining balances of the purchases payable in installment thereby resulted in increase of Net worth.

I agree completely with this forum's editorial in criticizing the behavior of the senator -judges in the Corona impeachment trial for " fraternizing and chit- chatting with the people in the gallery". As judges evolved in the litigation of this unprecedented event, these judges should observe proper decorum in every manner and respect, to show to the people that there is no familiarity going on in the handling of the trial.It is a known fact that this typical characteristic of Pinoy is universal in the culture of the country but with the nature and seriousness of the matter of the case in trial, these senator- judges should know better how to be appropriate when it come to this situations.

KOREKTOL: “Senate President Juan Ponce Enrile “red a fair trial with the decision to be based on the evidence presented and not on public opinion.” LINK Well, the Senate Trial Court set the tone how this case may be decided. Foremost, Counsel Serafin Cuevas contended in his opening statement, which has been admitted in evidence, that CJ Corona has been IMPEACHED WITHOUT NOTICE AND HEARING which means Corona’s basic Constitutional right that “No person shall be deprived of his life, liberty and property without the process off law” has been violated. Hence, the Impeachment is unconstitutional, and therefore, null and void and ineffective. How else may Corona be convicted?

RE:Former USEC of Justice Ramon Esguerra one of Corona's defense counsel was quoted: "The disclosure proves that he is filing the SALN and there fore did not violate the law...Mr Usec R. Esguerra ..it proves that he filed his SALN but the question is? Where did he get the money to buy those condominiums.. From his salary as Prof. of Law at the Ateneo.?. or as a Partner in a Law office that charges "New York Rates".. But he has been a Justice of the Court for 9 years is there a private practice inside the SC? that is the question.

I used to be a regular subscriber of Teddy Locsin's newspaper when I was a student (Undergraduate/Graduate.) at PNC. I disagree with Teditorial argument that the Philippine Supreme Court is 'supreme' & above other branches of the government because it has the power of judicial review---the power to declare congressional acts invalid if they violate the Constitution. But this power simply reflects in the will of the people as opposed to the will of the legislature, expressed in its statutes." If judges make a mistake, the Filipino people or their elected representatives have the means to correct the error, through constitutional amendments & impeachment. This is Political Science 101 in action, sir!

Corruption in all branches of Philippine government is preventing investments from big multinational firms due to mistrust. Government should be the good example. What's happening now is a forceful political overhaul that can be construed as executive intervention of the judiciary at its worst. I can only hope that a renewed social conscience will emerge out of these divisions so that a new breed of honest and transparent government will unite its citizens into becoming the pride of the orient once again; a government that respects the rights and integrity of its own people.

Under the present Aquino Administration, it is perceived that the CPP will be awarded to share the government power to governed as a condition for them to sign a peace agreement. Pres. Wang Wang is given up democracy and starting to consolidate to control the 3 branches of government. Surely, in his Cabinet is already infiltrated with CPP sympathizers and activists as his close advisers.

Re: "PNOY sacks Gatdula as NBI Director. This is one of the reasons why the Filipino people must support President Aquino's strong administration. It is crystal clear that President Aquino is a statesman. Why? I do think President Aquino holds courage as a political virtue because his care & concern with individuals, communities, universal human rights, & justice. This is crucial for the existence of a virtue. If someone says that he cares for some individuals, but is unwilling to risk harm or danger on his/her, or its own behalf, he puts the sincerity or geniuses of his care & concern in question. Supporters & lawyers of corrupt & partial Justice must reflect on this before they castigate President Aquino as a dictator.
