I agree with A. Poli that Sen. Miriam D. Santiago made a good job and exposed that the Prosecution vs CJ Corona is merely doing a big EXPEDITION. They don’t have a good case vs the respondent. They are banking on possible good ground that may be uncovered by their expedition/trial on ARTICLE 2 of the Articles of Impeachment (i.e., non disclosure to the public of respondent’s SALN) that may possibly prove that respondent is possibly guilty of any impeachable offense. How long, until the impeachment trial concludes? The problem is the lengthiness of this trial is indefinite. This is a one-time opportunity, so she should not miss it. A POLI: The impeachment of Corona is no fishing expedition. I think article 2 is a strong case. The problem however is the inability on the part of the prosecution to make the case. When it comes to ill gotten wealth, conventional wisdom tells you to link SALN, ITR, and bank activities or record of Corona and family. I think Senator Arroyo doesn't know that any judge could be impeached, tried, convicted, & removed from the bench if guilty of "treason, bribery, or other high crimes & misdemeanors." He cited the impeachment case of former President Clinton, but he ignored the case of Judge Pickering, who was removed from the bench for misdemeanors (intoxication & profanity). In fact, Justice Corona could be removed for giving false material information in his SALN, which constitute fraud, lying, dishonesty & other crimes of misdemeanors, under general principles of law. This is a possible basis of criminal liability on the part of a lawyer (see Rule 4.1 ABA Model Rule).

In the news: "Prosecutions Has No Proof On 45 Assets". The prosecution said this during the opening statement that Corona has 45 properties some of which were not declared in the SALN. As I said one or both parties of a litigation in their opening statements may said something about their respective sides of the case but they are not compelled to dwell in it in the course of the trial. Senator Enrile asked the House prosecutors what constitutes other high crimes & misdemeanors, without understanding the vagueness of the phrase "high crimes & misdemeanors." Senator Enrile should educate himself by revisiting the history of Pres. Nixon's impeachment: accused of criminal misconduct (24 Jul 1974), violating his oath of office (27 Jul 1974), been found guilty of a serious act of omission (05 Aug 1974), & so on.
