A handful of Filipino legal scholars deride the high court for its numerous questionable rulings that often defy logic, and private businesses as well as government agencies are continually frustrated by the court’s penchant for reversing itself—even on decisions that it had previously ruled with finality. According to one veteran lawyer, the one time he was actually impressed by the clarity and succinctness of the arguments in a Supreme Court decision was one that later turned out to be copied from foreign court decisions published on the internet. Very early on, the Senate impeachment court learned that the Justices’ SALNs (Statement of Assets, Liabilities, and Net Worth) were not made available to the public since the Narvasa Court’s 1992 ruling (click here for our editorial on it) based on a laughably simplistic argument that Justices might be subjected to what that court termed “fishing expeditions” by parties wanting to get back at the court. A few sessions later the impeachment court learned that the Supreme Court would not honor any subpoenas issued by it, even though the Constitution clearly states that the Senate impeachment court has the sole authority to try impeached justices. The high court dug in its heels making it known to one and all that it bows to no one. Now, the public
learns—based on the testimony of their own witnesses, that there are no hard
or fast rules that require Supreme Court Justices to account for their
allowances and emoluments—which are not even subject to withholding tax.

the barriers it has further managed to construct over the decades to prevent
“outsiders” from meddling or even knowing what goes
This state of affairs, if allowed to continue will foster an institution where corruption is widespread and unmitigated; where those who are appointed to uphold justice will instead sell it to the highest bidder. And as a consequence the country will fall even further behind its neighbors, and the rest of the world. It is time Filipinos everywhere band together and take back their judiciary. If that means impeaching the Chief Justice and all his accomplices then so be it. Thereafter, install righteous individuals in their place and institute changes that would make the court more transparent and more accountable to the Filipino people. One corrupt judge or justice can wreak a lot of havoc that could affect multitudes and take generations to rectify. Thus, not only should judicial appointments be of the highest moral caliber, but safeguards must be set in place in order to detect any anomaly or infraction so it can be immediately corrected. If this generation of Filipinos can accomplish this, it will lift a heavy burden from our children and grandchildren who will be able to focus on the myriad other issues they will have to face to keep the Philippines moving on the right track.
