The Public Might Have the Final Say in This Impeachment Trial After All

aws are like sausages, it is better not to see them being made” said Otto von Bismarck.Senator-judges during the course of the trial And after 34 days of gavel-to-gavel coverage of Chief Justice Renato Corona’s impeachment trial—essentially run by lawmaking Senator-judges—TV viewers now realize that a Philippine impeachment trial can be just as nauseating. The reason is that some Senator-judges appear to have this uncontrollable urge to show off at the sight of TV cameras. The need to prove that they are smarter than you and me—whether it be Sen. Miriam Defensor Santiago’s off-the-mark lecturing, or Sen. Jingoy Estrada imagining he is Perry Mason and Columbo rolled into one, or Sens. Loren Legarda and Pia Cayetano acting as if they are paragons of fairness, or Sen. Juan Ponce-Enrile occasionally losing focus and wandering off into lala-land—all become extremely annoying to watch after a while. Then there’s Sen. Joker Arroyo who more often than not appears bored with the entire proceeding and seems ready for a little siesta instead.

When it comes to impeachment rules, the Americans seem to have gotten it just right. After all, most procedures we presently have are lifted from the American model. Unfortunately one rule that the Philippines did not pick up is found in paragraph 19 of the US Senate rules on impeachment trials. That rule states: “If a Senator wishes a question to be put to a witness, or to a manager, or to counsel of the person impeached, or to offer a motion or order, it shall be reduced to writing, and put by the Presiding Officer.” In other words no US Senator is allowed to go up to the podium and prattle-away the way Philippine Senators can. A US Senator must instead put his or her question in writing then hand it to the Presiding Officer who will read it out loud. If the Philippines had adopted that rule, the Corona impeachment trial might be over by now…or at least, much further along.

Finally, despite the Senator Judges protestations to rendering a fair and just decision, keep in mind that an impeachment trial is a quasi-political undertaking. It is very likely that not one of these Senator-judges is prepared to commit political suicide by going against overwhelming public sentiment to vote their conscience. These Senator-judges are all savvy political operatives with a keen sense of which way the political winds are blowing. They are not about to give up the perks, the prestige, the national stage, the fame, the media attention, Macel Jimenez, a UP law graduate worksand everything else a senatorial seat comes with—no matter how strong their personal conviction may be. In reality politics is very much like show business, so much so that Jonathan Alter of Newsweek describes Politics as "show business for ugly people.”  And like show business, it can be just as beguiling.

Therefore, at the end of the day, it will boil down to what the majority of Filipinos believe. If they believe Corona is guilty, count on the Senator-judges to convict...but if they believe he is innocent, then expect the Senator-judges to acquit. In short, "we the people" hold the key to Corona’s fate! But for the time being let’s just give these Senator-judges their moment under the Klieg lights. When the trial resumes in a few weeks and you again feel your blood pressure rising, you can always reach for the remote. Better yet, you can bide your time trying to spot the many pretty faces in the gallery, like the one we show above. Published 3/22/2012

What a relief to have a holiday break from these senate proceedings. At this point, it's agreeable that most Filipinos following this have impeachment-fatigue of hearing 'your honor' that & 'your honor' this. Not to mention Sen. Santiago on her cranky outburst & ballistic dressing down of her colleagues in the senate & congress. The latest Pulse Asia poll found that 60% of Filipinos don't trust CJ Corona. So, a few more points if added, then, perhaps a conviction is in order. To sum it up, these crooks & corrupt govt servants were able to do away with all these self-serving laws that only benefit themselves & are untouchables to outsiders. Filipinos should unite & demand that justice must be done & that Cheap Justice Corona et al hang.

Why would a mayor approve the disbursement of P34.7 mil from the city's account with a certificate that is 11 yrs old? Did the mayor went along with the sale bcoz of R. Corona's undue influence on the matter? In the impeachment trial of Corona, the Supreme Court should never interfere with the work of Congress by threatening the latter with TRO and other forms of interlocutory orders. That would have been Contempt of Congress. Supreme Court does not have any authority to halt the impeachment of Corona, unless the Constitution agrees with them that they have the last word. I have never seen a court so stupid as this court. How did these justices get there? These justices have never been vetted. They were hired on the spot!

Of all the Senator Judges, Sen Santiago had the audacity to use the words Human Relation while berating a witness in her loud shrilling voice. She said, -look at me- to the witness as if she was talking to a 5 year old. She needs to be re-evaluated for psycho reasons bcoz no judge should talk like that to a witness in any court. At the end, CJ Corona was not cleared of all his properties as the prosecutors had documented. Three or 4 properties not declared in Corona's SALN plus his bank accounts are enough to find him guilty.

It is very evident that the Philippine Supreme Court has lost the reverence of the public it once had. The reign of Gloria Arroyo has a lot to do in the damaged judiciary. Supporting the midnight appointment of Corona in early 2010, the SC clearly violated provisions of the Constitution as pointed out by no less than Fr. Joaquin Bernas and Justice Artemio Panganiban. And it seemed, the SC has gotten away with it. Now in the hands of CJ Corona, the image of SC has suffered badly because of the many inconsistent, irregular and flip flopping decisions. The rule on impeachment trials was changed because of the lawyers in the Senate who think they are bright, with the modern times, we don't need bright people all we need are smart (logical, not bookish) people. The impeachment is actually a investigation/inquiry...to determine if CJ is/has capability, integrity, trust, probity and confidence of the people and executive. The impeachment of the chief justice delivered a very strong signal that something must be done to deviate from old bad habits. It has created a huge crack that only demolition is the remedy. William telus: The impatience of the people is about to be reached by the people. The disappointment of the public has become very obvious. I believe the mood of the people is to convict Corona and get him out of the Supreme Court now. Allow the government to go on with other business. How can you take this Impeachment Court seriously! After all the fire and brimstone they hurled at each other for weeks the protagonists now declare a "Break for Lent". An "Easter Truce", they call it, allegedly to make personal, spiritual reflections and in observance of the Holy Week. They then immediately went politicking/campaigning for/against Corona. I was born a Filipino and will remain one, at heart. But, I cannot help but say that I am afraid to return because the Philippines has remained a very corrupt country. It has not improved it's economic outlook to level comparable to other Asian countries. This raucous impeachment process in Corona's trial makes this country's Congress look stupid and immature. Crucial issues are not being raised but instead trivial ones are continuously being revived and revisited. Unnecessary delays for its early resolution are expected to happen. Impeachment fatigue is bound to be experienced too by those who are following the trial. The goal is simple in any impeachment trial; it is intended to arrive at the TRUTH but never serving justice as in criminal cases. I've been watching the on going impeachment trial and I think that there are those who are doing their job fairly. It is hard to imagine that after all this trial, it is the public who will have the last say. Acacia: The impeachment has always been viewed as political. This is the first time that people are exposed to an impeachment trial. It is just like having the first snow dusting in the streets of Manila. One thing I admire for PNoy, he first castigated GMA, Abalos, CJ Corona, Garcia Ligot, the heads of corrupts. He's clever for what he did. Although CJ Corona's trial has not yet ended, I'm convinced of his illegal acts because being the chief justice he will always be tempted to do illegal business. I believe this impeachment takes more longer time to reach for conclusion as shown the way the defense panel maneuver the strategy to delay and to have too many matters for debate. By all means they will find ways to correct the wrong and vice versa to best rescue their client no matter what, after all thru this manner they are being paid for. Senators-Judges should take utmost care to render the verdict in this regard. It is crystal clear that CJ Corona crossed the line therefore should be penalized.
